I. INTRODUCTION

This document (together with all documents referred to in it) sets out the terms and conditions governing your use of this website (WWW.GLOWRIAS.COM) and your purchase of products from it. Please read these Terms and our Privacy and Data Protection Policy carefully before using this website. By using this website or placing an order through it you agree to be bound by these Terms and our Data Protection Policies, so if you do not agree to all of the Terms and the Data Protection Policies, you must not use this website.

These Conditions may be modified. It is your responsibility to read them periodically, since those that are in force at the time of placing orders will be applicable or, in the absence of these, those that are applicable at the time of using the website will be those that are applicable to you. If you have any questions related to the Conditions or the Data Protection Policies, you can contact us through our contact form.

The contract is formalized in Spanish.

By using this website and placing orders through it you agree to:

Use this website only to make legally valid inquiries or orders.

Do not place any false or fraudulent orders. If it could reasonably be considered that such an order has been placed, we will be entitled to cancel it and inform the relevant authorities.

**NOTE: The same will apply to actions arising from the contract that are fraudulent (see, for example, the rejection of a shipment in bad faith or the fraudulent claim for the return of a defective product).

Provide us with your email address, postal address and/or other contact information in a truthful and accurate manner. You also agree that we may use this information to contact you if necessary (see our Privacy Policy). If you do not provide us with all the information we require, we will not be able to process your order. By placing an order through this website, you declare that you are over 18 years of age and have the legal capacity to enter into contracts in accordance with the provisions of the Civil Code.

The items offered through this website are available for shipping to the countries listed on our website.

VI. HOW TO PLACE AN ORDER

To place an order, you must follow the online purchasing procedure and click on "Authorize payment". After this, you will receive an email acknowledging receipt of your order (the "Order Confirmation"). In addition, the transport company that works with us (CORREOS) will inform you by email that the product is being shipped (the "Shipping Confirmation").

The Purchasing Guide covers the purchasing process in more detail, so you can consult it at any time.

VII. TECHNICAL MEANS TO CORRECT ERRORS

If you detect that an error has occurred when entering your personal data, you may correct errors related to the personal data provided during the purchase process by contacting customer service via email at pedidos@glowrias.com (more information contained in the Shipping section of our website).

This website provides details of all the items you have added to your basket during the purchase process, so that you can modify your order details before making the payment. If you detect an error in your order after completing the payment process, you must immediately contact our customer service team at the email address mentioned above to correct the error.

If you realise your mistake once the order has been shipped, you will have to bear the same cost OF THE CARRIER when you placed the order for the first time, to send the order a second time to the correct address.

VIII. AVAILABILITY OF PRODUCTS

All orders are subject to product availability. If there are any difficulties in supplying products or if items are out of stock, we will refund any amount you may have paid.

IX. DELIVERY

Unless there are unforeseen or extraordinary circumstances or errors arising from the computer system, the transport company or lack of information provided by you for the shipment, we will send you the order consisting of the product/s listed in each Shipping Confirmation within the period indicated on the website and, in any case, within a maximum period of 15 days from the date of the Order Confirmation. It is important to bear in mind that the aforementioned shipping times may be subject to delays in the case of mass sales periods such as: Sales, Liquidations, Glowrious Days, Black Friday and similar.

You will choose the place of delivery of the order: Pick up at our store (if enabled on the WEB) or home delivery. If you have chosen the home delivery option and are absent at the time of delivery, you can arrange with the contracted transport company a new delivery to your home, pick up at the offices or delivery point.

If for any reason we are unable to meet the delivery date, we will inform you of this circumstance and give you the option of continuing with the purchase by setting a new delivery date or cancelling the order with a full refund of the price paid. Please note, in any case, that shipments are not made on Saturdays, Sundays or public holidays. It is also worth noting that orders are dispatched within 48 hours after confirmation (which is the order preparation time) and, once collected by the transport company, take a maximum of 72 hours to arrive.

For the purposes of these Conditions, "delivery" or the order being "delivered" shall be deemed to have taken place at the time when you, a third party indicated by you (or if you are absent, a neighbour of your property) acquires physical possession of the products, which shall be confirmed by the signature of receipt of the order at the agreed delivery address. The delivery note shall state the name of the person who collected the order and the capacity in which he/she does so.

For orders that are "picked up in store", "not picked up at the carrier's offices" or "returned to our offices by the carrier due to delivery failure", the customer has 3 MONTHS to claim their order. After these months, the packages will be destroyed. Claims for these can be made within 3 MONTHS from the order being placed.

X. IMPOSSIBILITY OF DELIVERY

The CARRIER will make several delivery attempts. He will also call you on your phone and send you successive emails to the address you have provided to inform you of the status of your shipment. Therefore, if for any reason you are unable to receive the shipment, the carrier will offer you different points close to your home or work so that you can go and collect it at the time you consider convenient.

In the event that after successive attempts, calls and various communications from both THE CARRIER and GLOWRIAS, you do not take charge of your package, your order will be returned to our warehouse. In the event that 15 days have passed since your order was available for delivery and the order has not been delivered for reasons not attributable to us, we will refund all payments received from you, excluding the cost of shipping and return with all expenses related to said shipments within a maximum period of 14 days from when we receive the goods in our warehouse. Please note that the transport derived from the termination may have an additional cost, so we will be authorized to pass on to you the corresponding costs that THE CARRIER charges us due to its conduct.

XI. STORE PICKUP

Pick-ups will be available in store 15 business days from the "email confirmation to the customer that they can pick up their order in store". After these 15 business days, the order will be sent to the warehouse for sorting and the customer must pay the shipping costs to their home address.

XII. TRANSFER OF RISK AND OWNERSHIP

The risks of the products will be yours from the moment of their delivery. You will acquire ownership of the products when we receive full payment of all sums due in respect of them, including delivery charges, or upon delivery, if this takes place at a later date.

XIII. PRICE AND PAYMENT

Prices on the website include VAT but exclude delivery costs, which will be added to the total amount due. Prices may change at any time, but (except as stated above) any changes will not affect orders for which we have already sent you an Order Confirmation. Once you have selected all the items you wish to purchase, they will be added to your basket and the next step is to process the order and make the payment. To do so, you must follow the steps of the purchase process, filling in or checking the information requested at each step. You can also modify the details of your order during the purchase process, before making the payment. A detailed description of the purchase process is available in the Purchase Guide. You can use VISA, MASTERCARD, MAESTRO, AMERICAN EXPRESS cards or the SHOP PAY, APPLE PAY and GOOGLE PAY applications as a means of payment. You can also pay all or part of the price of your purchase with a voucher issued by GLOWRIAS. Payment is also permitted by direct deposit or bank transfer. By clicking "Authorize Payment" you are confirming that the credit card is yours or that you are the legitimate holder of it. Credit cards will be subject to verification and authorization by the issuing entity, but if the entity does not authorize payment, we will not be responsible for any delay or non-delivery and we will not be able to enter into any contract with you.

At the end of the purchase process, the system will ask you to confirm it. By clicking this button and entering your details for shipping and payment, you are unequivocally expressing your desire to make a purchase on this website.

XIV. VALUE ADDED TAX AND BILLING

In accordance with the provisions of article 68 of Law 37/1992, of December 28, on Value Added Tax, the delivery of the articles will be understood to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory, except for the Canary Islands, Ceuta and Melilla. The applicable VAT rate will be the one legally in force at any given time depending on the specific article in question. In orders destined for the Canary Islands, Ceuta and Melilla, deliveries will be exempt from VAT by application of the provisions of article 21 of Law 37/1992, without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of these territories. You expressly authorize us to issue the invoice in electronic format, although you may indicate at any time your desire to receive an invoice in paper format, in which case, we will issue and send the invoice in this format.

XV. RETURN POLICY

XVI. Legal right to withdraw from the purchase Right of withdrawal

If you are contracting as a consumer and user, you have the right to withdraw from this contract within a period of 14 calendar days without the need for justification. The withdrawal period will expire 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired material possession (date of purchase) of the goods or, in the event that the goods that make up your order are delivered separately, 14 calendar days after the day on which you or a third party indicated by you, other than the carrier, acquired material possession of the last of those goods. To exercise the right of withdrawal, you must notify GLOWRIAS by writing to us at pedidos@glowrias.com of your decision to withdraw from the contract using the following form, which constitutes an unequivocal declaration of the same.

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of this right before the withdrawal deadline expires.

In the event of withdrawal from this contract, we will refund all payments received from you, including those relating to the delivery of the least expensive delivery method available (with the exception of the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by us) without undue delay and, in any case, not later than 14 calendar days from the date of purchase, you must inform us of your decision to withdraw from this contract. We will proceed to make said refund using the same means of payment used by you for the initial transaction. You will not incur any costs as a result of the refund. Notwithstanding the foregoing, we may withhold the refund until we have received the goods back, or until you have supplied proof of the return of the goods, depending on which condition is met first.

Returns without prior communication or without complying with the conditions set out in our Returns Policy will not be accepted.

Once you have verified that your return complies with all the established requirements, you must return or deliver the products directly to us in our store or through a courier, without any undue delay and, in any case, within a maximum period of 14 calendar days from the date on which you notify us of your decision to withdraw from the contract. The deadline will be considered to have been met if you return the goods before said period has concluded.

Unless you return the goods to our physical store (if enabled in the WEB store), you must assume the direct cost of returning the goods. You will be responsible for any decrease in the value of the goods resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods. You are also responsible for returning the product to us in the same condition in which it was sent by us.

The following goods are excluded and cannot be returned by legal obligation: Sealed goods that have been unsealed after delivery and that ARE NOT SUITABLE FOR RETURN for reasons of health or hygiene (swimsuits, bodysuits, costume jewellery, sunglasses, etc.). Goods subject to reservation or advance purchase (the user has specified his/her wish to have a product that is out of stock and discontinued made for him/her).

You will also lose your right to withdraw if the goods are not in the same condition as when they were sent. This means: used, unlabeled, worn products.

XV.II. Contractual right of returns

The private returns policy can be found in the returns policy section of our website and can be consulted there. All of this, without objection to being able to use the right of withdrawal that the law recognizes to the consumer.
